Laws and statutes regarding bail amounts, eligibility and penalties for violating bail are all outlined in state and national laws. While some laws and guidelines will vary from state to state, United States Code, Title 18, Sections 3141 through 3150 contain specific information regarding bail.
In 1984, U.S. Congress replaced the previous law regarding bail, the Bail Reform Act of 1966. One of the most notable changes under the new laws was the implementation of bail denial if a person was deemed to be a danger to the community. Previous laws and statutes had based denial of bail upon the defendant's flight risk - the likelihood that he or she would flee.
When Bail May Be Denied
U.S. Code, Title 18 Section 3142 f) contains information regarding certain instances where a person might be denied bail. These include:
- Violent crimes, drug crimes, or other offenses which are punishable by a maximum sentence of 10+ years.
- Offenses punishable by life in prison or the death penalty.
- Any felony offense, if the offender has previously been convicted of 2 or more serious crimes as outlined above.
- The court has determined there is a serious risk that the defendant may attempt to flee.
- The court has determined that the defendant may pose a very real danger to witnesses, jurors, or others associated with the case, obstructing justice in any way.
