A surety bond is a contract that involves three parties: the bail bond agent, the person charged with a crime, and the court. Under this agreement, the bail bond agent agrees to uphold the obligations (the bail amount) of the defendant if he or she fails to appear at one or more court appearance, so the court can still collect the bail amount promised. In this way, the entire bail amount will not be paid up front when you are released from custody; it will be paid if you default on the agreement (do not show up to your court appearances.) Some surety bonds will also include additional conditions, such as the completion of drug treatment or the like.
Surety bonds require a relationship of trust and understanding between the bail bond agency and the person who has been charged with a crime. The bail bond agency, in essence, is taking responsibility for the defendant showing up to all court appearances.
