Orange County Property Bonds
California Bail Bond Agent Dan Nesser
A Property Bond is a less common way of posting bail so a defendant can be released from custody. During this process, real property (a house, building, etc.) is placed with the court as a guarantee that the defendant will show up to all necessary court proceedings. The court records a lien against the property for the bail amount, whatever it may be. Under a Property Bond, if the defendant fails to show up to mandatory court appearances the court can start the process of foreclosing on the property to obtain the full bail amount. However, if the defendant shows up to all court appearances, the court will then release the lien and take no action against the property.
Property Bonds are an often complex and time-consuming type of Criminal Bail Bond. This release option usually requires prior approval by the magistrate as well as full property disclosure including, but not limited to, an appraisal. This option is actually not offered through many states in the U.S.
