Release on "Own Recognizance"
Orange County Bail Information
Although we cannot give any legal advice regarding how to obtain a release on your own recognizance (without being required to post bail), we have provided information regarding this option as it is related to bail.
Being released on one's own recognizance means that you are released without having to post bail. This option is not offered to everyone and is usually available only to those individuals who have no past criminal record and have committed a non-violent criminal offense. Issues such as a person's ties to the community and his or her likelihood of fleeing are taken into consideration as well as the defendant's potential danger to the public.
As mentioned in U.S Bail Law, some defendants may be denied bail entirely based upon their potential danger to the public, their flight risk or the type of crime they have committed. When these issues are not a factor, and the crime was minor and not violent, the person may be released without having to post bail or contact a Bail Bond Agent whatsoever.
When Will Bail Be Waived?
If a person has many ties to a community, such as friends, family and property, when a person is in good standing with the community, and when a person is generally perceived to be of good character, he or she may be released on his or her own recognizance. Whether you or a loved one is released without bail will depend upon various factors. It is best to consult an attorney regarding this issue, to see if you qualify.
