Bail is an amount of money, usually set by a judge, a defendant must give as a promise that he or she will return at a certain appointed time or times. After an arrest and before a formal trial, a judge will usually determine a bail amount for the defendant in order to ensure that he or she does not flee after release from jail. The defendant is needed at certain court dates and bail is a way to ensure he or she shows up to these appointments. If the defendant does in fact show up to his or her court appearance/s, the court will refund the money or will return the property that was used to post bail.
There are four ways bail may be covered or paid:
- Cash or check can be paid for the full bail amount.
- Property worth the full amount of bail can be surrendered.
- A Bail Bond can be issued - a guaranteed payment of the full amount written by a Bond Agent.
- Waiver of payment can occur, on the condition that the defendant appears in court. This is also known as "release on one's own recognizance" and usually reserved for lesser crimes, first time offenders, or defendants who have many ties to the community and are not a flight risk

The Bond Agent helps to ensure the defendant shows up to all court dates and does not flee. If the defendant tries to flee and avoid their court dates, the Bond Agent may hire a bounty hunter to track down and capture the defendant.
